The US Justice Department advised the White House in August 2002 that torturing al-Qaeda detainees could be justified, according to a memo.

Of course, this not proof that the US government acted on that advice. But the logic is worrying and familiar. Remember how Bush insisted US troops be immune to prosecution for war crimes in the International Criminal Court? And that immunity has been granted in Iraq?
